CompuTouch offers wireless internet access that’s more than 10 times faster than that of a 28.8 Kbps modem connection. Using  wireless internet access, you will always be online 24/7, meaning you’re always connected to the internet, with never a busy signal.  wireless internet is the way of the future, but it is still relatively new to the area. Optimal conditions need not apply as the thirst for high speed wireless internet services grows, the word wireless internet looms in the air. Most of the internet community has heard of DSL, ISDN, and Cable, but few have heard of a wireless internet connections.

When the word Wireless is said, most think about cell phones and pagers, but it is so much more. High speed wireless internet is using wireless equipment to create an internet connection faster than just about any connection out there.

The equipment consists of access units (which transmit the signal), and subscriber units (which receive the signal, can be an antenna or something similar to a dish). This equipment can allow someone to surf the internet at speeds faster than DSL and Cable.

  Use Agreement

Client agrees to receive access to the CompuTouch network services
according to the following terms and conditions:

 

1. Selection of Service Plan.
Client will select one of the service plans offered by Provider, and agrees to receive services according to the service plan selected.

2. Payment for Services.
Client will pay for services provided under this Agreement. When initiating service, Client will be charged the published setup fee for the service plan selected. Client's credit card will be charged for monthly payment for services according to Provider's published schedule. If this Agreement is terminated on some day other than the last day of the payment schedule, Client will be obligated to pay for only the pro rata portion of the monthly service plan charge for the month in which the service is terminated.

3. Term.
This Agreement may be terminated by Client or Provider at any time without prior notice and without cause. If either party is in default under this Agreement (including nonpayment), then the non defaulting party may also immediately terminate the Agreement without prior notice to the other party.

4. Compliance with Law.
Client will use the services offered by Provider in a manner consistent with all applicable local, state and federal laws and regulations.

5. File Back-up.
Provider is not responsible for Client's files residing on Provider's servers. Client is solely responsible for independent backup of data stored on Provider's servers.

6. Prohibition of Publication of Certain Material.
Client shall not knowingly or unknowingly submit to Provider for
publication any of the following material (including pictures, links, or any other content):
(a) any material which violates or infringes any copyright, trademark, trade secret, patent, statutory, common law or other proprietary rights of others;
(b) any material that is libelous or slanderous; or
(c) any material which is or contains anything obscene or pornographic;
(d) distribution lists to be used via unsolicited electronic mail or other
mass electronic mailings including but not limited to: mass-newsgroup
postings, SPAM and unsolicited email sent from your server, or any
other service on the Internet, which contains your domain name or any
other domain name on our network.
Any violation of the above conditions will result in termination of
Client's account and a fine, not to be less than $20 and not to exceed
$500, with the amount determined by the severity of the infraction, and
the history of the spammer. If applicable, bandwidth consumed by the spamming activities will also be billed for, at double the current business price.
Due to the public nature of the Internet, all material submitted by Client for publication will be considered publicly accessible. Provider does not screen in advance Client's material submitted to Provider for publication. Provider's publication of material submitted
by Client does not create any express or implied approval by Provider
of such material, nor does it indicate that such material complies
with the terms of this Agreement.

7. DISCLAIMER OF WARRANTIES.
PROVIDER'S SERVICE IS PROVIDED ON AN 'AS IS, AS AVAILABLE' BASIS.
PROVIDER SPECIFICALLY DISCLAIMS ANY OTHER WARRANTY, EXPRESS OR
IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL PROVIDER BE LIABLE FOR ANY CONSEQUENTIAL, INDIRECT, SPECIAL OR INCIDENTAL DAMAGES, EVEN IF PROVIDER HAS BEEN ADVISED BY CLIENT OF THE POSSIBILITY OF SUCH
POTENTIAL LOSS OR DAMAGE. IF PROVIDER'S SERVICE TO CLIENT IS DISRUPTED OR MALFUNCTIONS FOR ANY REASON, PROVIDER SHALL NOT BE RESPONSIBLE FOR LOSSES OF INCOME DUE TO DISRUPTION OF SERVICE, BEYOND THE FEES PAID BY CLIENT TO PROVIDER FOR SERVICES, DURING THE PERIOD OF DISRUPTION OF MALFUNCTION.

8. Limitation/Disclaimer of Liability.
Provider is not liable for protection or privacy of electronic mail or other information transferred through the Internet or any other network provider or its customers may utilize.
Provider does not represent or warrant to Client that Client will receive continual and uninterrupted service during the term of this Agreement. In no event shall Provider be liable to Client for any damages resulting from or related to any failure or delay of Provider
to provide service under this Agreement if such delays or failures are due to strikes, riots, fire, inclement weather, acts of God, theft or vandalism or other causes beyond Provider's control, as defined by standard practices in the industry. Such failure or delay shall not constitute a default under this Agreement.

9. Indemnity.
Client agrees to defend, indemnify and hold Provider harmless from and against any and all claims, losses, liabilities and expenses (including attorneys' fees) related to or arising out of the services provided by Provider to Client under this Agreement, including without
limitation claims made by third parties (including customers of Client) related to any false advertising claims, liability claims for products or services sold by Client, claims for patent, copyright or trademark infringement, claims due to disruption or malfunction of
services provided hereunder, or for any content submitted by Client for publication by Provider, but excluding those related to the negligence of Provider.

10. Resale of Provider's Service.
If Client acts as a 'reseller' of the services provided by Provider to Client hereunder, by Client providing similar services to its customers, then all the terms of this Agreement shall provide to the resale. Without limiting the foregoing, Client's obligations under Section 9 ('Indemnity') shall apply to any and all claims made against Client and/or Provider which arise out of the resale of Provider's services.

11. Governing Law/Venue.
This Agreement shall be governed by the laws of the State of Nevada. Venue for any action hereunder shall be in Clark County, Nevada.

12. Relationship of the Parties.
The parties intend that an independent contractor relationship will be created by this contract, and that no partnership, joint venture or employee/employer relationship is intended.

13. Taxes.
If any federal, state or local governmental entity with taxing authority over the services provided under this Agreement imposes a tax directly on the services provided by Provider to Client under this Agreement (excluding any income, business and occupation, capital gain, death or inheritance, or other indirect taxes), then Provider may pass the direct amount of such cost on to Client, and Client shall promptly pay such cost.

14. Waiver.
Any party's failure to insist on compliance or enforcement of any provision of this Agreement shall not affect its validity or enforceability or constitute a waiver of future enforcement of that provision or of any other provision of this Agreement.

15. Attorneys' Fees.
If a legal proceeding is commenced to enforce or obtain a declaration of rights under this Agreement, the prevailing party in such proceeding shall be entitled to recover its reasonable attorneys' fees
and costs incurred in the proceeding from the non prevailing party, as well as any reasonable attorneys' fees and costs that the prevailing party incurred prior to commencing the proceeding.

16. IP Addresses.
Provider maintains control and any ownership of any and all IP numbers and addresses that may be assigned to Client and reserves in its sole discretion the right to change or remove any and all IP numbers and addresses.

17. Cancellation.
In order to stop service, Client must follow the cancellation procedure which can be obtained from Provider.

What is Broadband?
Wireless broadband is a technology where your connection to the Internet is made by a radio link to one of our antennas. This allows us to do some pretty amazing things. First, we aren't limited by cables like DSL or Cable Broadband; our connection to you passes through the air. Since we aren't trying to make older technology (like television cable) work for data, we can achieve incredible speeds both from the network to you, and from you out. Broadband is an always-on connection capable of providing simultaneous mixed media (phone, fax, Internet) over the same line with speeds that are substantially greater than a typical dial-up connection.


How does all this work with one computer?
Both the single and multi-computer installations begin with an antenna and indoor radio transceiver. The antenna is approximately 12 inches by 12 inches in size and will reside within the attic of your home, on an exterior wall, or atop your roof, pointed at our base station. An antenna cable (coaxial; similar to TV cable) runs from this device down into your house where it connects to the wireless transceiver. The transceiver connects to your computer via a USB cable. Your computer will need to have an USB port to connect to the transceiver. Most late model computers include USB ports. In a few simple install steps on your computer, you're surfing the web. We'll do all the work and provide all the equipment necessary.


Can I hook up my home network to your service?
Yes! You can hook up as many computers as you want to the transceiver via an Ethernet hub, switch or router.
We also offer  routers, switches and hubs, both wired and wireless, for your home networking needs.


Does your service use my current phone line?
Not at all! With CompuTouch service you can talk on the phone and surf the Internet at the same time. CompuTouch will never tie up your phone line in any way.


Are the radio connections harmful?
RF is a form of electromagnetic signal that can pass through the air, walls, and for short distances even you! However, the signal power for our equipment is significantly lower than a normal cellular phone! CompuTouch strives to ensure the safety of its customers.


What about privacy? Is someone watching what I do online?
Not at all. CompuTouch does not monitor nor keep logs of what individuals using the service are doing beyond total bandwidth used and time online (to track the amount of data being transferred for billing purposes, but not the activities being performed). These are used to help maintain the network only, and plan for expansion of our connections to the Internet. This also means that YOU are responsible for your own parental controls on your computer. We do not filter any access to the net and we are not responsible for any content you find on it that doesn't reside on our servers. If you wish to have inappropriate content filtered, CompuTouch will be more than happy to install third-party software on your computer.


I have a laptop. Can I surf from my back porch or within your coverage area?
In most cases, users are too far away from the base antenna to be able to receive a signal via a laptop card. However, we can provide you with an inexpensive wireless access point and laptop cards you can use to connect to your CompuTouch-provided broadband equipment via a router, hub or switch.


Will I lose my connection every time a bird flies by or it rains?
Absolutely not. The hardware automatically corrects and compensates for brief interruptions, so even if a bird did happen to get in the way (and it would need to be a REALLY big bird) you probably wouldn't even notice. RF is not greatly affected by weather, so feel free to surf right through the rain! (Lightning is occasionally an issue in Pennsylvania. Most externally mounted antennas will be equipped with a lightening arrestor, but we recommend you not operate your computer, not just the wireless network, during lightning storms as surges through the power system may damage or destroy your computer.


What is the coverage area for CompuTouch service?

How fast is CompuTouch?
CompuTouch wireless Internet operates at a maximum burst of up to 3Mbps up AND down using our standard equipment. In reality, a raw data burst rate of 2.5Mbps is the maximum throughput due to wireless protocol overhead. Distance and cable length will affect maximum transfer rate. For example, if a customer is five miles away from a given tower, a possible up/down transfer rate might be 1-1.5Mbps, however if the customer is within two miles of the tower, he or she may very well attain full burst rate.

With special equipment, we can reach sites with up to 480 megabits a second.  Our backbone is currently 100 megabits a second.


Is CompuTouch compatible with all operating systems like Macintosh, Windows, Linux, Unix, OS/2 etc.?
Yes. Standard installation fees assume that your system is supported by the manufacturer's driver set. If it is not, an additional fee may be required. Any system that uses standard Ethernet will work with CompuTouch. If you have questions, please feel free to contact CompuTouch



How is CompuTouch different from DSL?
Most DSL providers deliver asymmetrical services. That means you may get fast downloads, but you can only upload, or send a file at a fraction of that speed. CompuTouch Offers fully symmetrical services that provide equally fast download and upload speeds. And since the CompuTouch Network has already been connected to your community, we can usually install your service in a matter of a few hours or days, not weeks like some DSL services.



How is CompuTouch different from a cable modem?
CompuTouch provides an individual connection to the Internet, unlike cable modems that provide a shared connection between residents. With a shared connection, the more users on the network, the slower the access speeds within the building. CompuTouch manages its bandwidth to help provide consistent speeds as Internet traffic increases.



What is the installation process?
In most cases, our installers will mount a small pizzabox-type antenna on your roof, on an exterior wall, or within your attic, and run the antenna cable inside your place of business. This cable connects to a CompuTouch transceiver, which is then plugged into your computer or network via an Ethernet network cable or Ethernet network cable and network hub. Alternately, a USB adapter may be used depending on the package purchased. Some plans even come with a firewall solution to help protect your business from many attacks. You will provide the Ethernet NIC card (network hubs are available from CompuTouch for a nominal charge), which is generally provided in many computers on the market today. An average install takes from one to two hours.



Is the CompuTouch service secure?
Aside from viruses and attacks from the Internet (which are applicable to any type of network), a common question of wireless networking is "can someone 'listen' to data on my wireless network". The answer is No. FHSS technology (Frequency Hopping, Spread Spectrum) was introduced 50 years ago by the military as a way of sending secure communications, and is fully utilized in the CompuTouch service. Signals are sent out over a multiple range of frequencies at very low power, making it virtually impossible to 'listen in' on a signal. For more information on our technology, please give us a call
